These terms and conditions ("Terms") govern your use of the Physioactive SA website (the "Website") and the services provided therein. By using and remaining on this Website, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use the Website.

 

  1. Definitions

"Client" refers to an individual seeking physiotherapy services through this Website.

"Physiotherapist" refers to the licensed healthcare professional providing physiotherapy services.

"We," "Us," or "Physioactive" refers to the physiotherapy clinic or website owner.

"You" or "User" refers to any person using this Website.

 

  1. Use of the Website

2.1 You must be at least 16 years old to use this Website.

2.2 You agree to provide accurate and complete information when using our services.

2.3 Your use of the Website is subject to our Privacy Policy, which can be found below under Privacy Policy.

 

  1. Appointments and Payment

3.1 Clients may schedule appointments through the Website or by contacting the clinic on (08) 85224232.

3.2 It is expected that all fees are paid in full at the time of consultation.

3.3 We accept cash, EFTPOS, credit cards and offer electronic healthrebates (via HICAPS) for your convenience.

3.4 Health Insurance rebates (electronic or otherwise) can only be claimed after the service has been received. In the instance of purchasing treatment passes, rebates will only be available once the treatment service has been completed.

3.5 Payment details and processing are handled securely and in compliance with applicable laws.

 

  1. Cancellation Policy

The following procedures have been put into place to alleviate the disruption to this clinic and to other patients.

We require notice to the clinic by 9am on the morning of your scheduled appointment otherwise a cancellation fee  (50%-100% of consultation fee-see further detail below) may be incurred.

We realise that appointments made in advance can be difficult to remember, so to help you from forgetting we do offer SMS reminders the day before your appointment.

Please note the cancellation fee will not be covered by your private health and will need to paid prior to your next appointment to continue treatment..

FAILING TO ATTEND YOUR SCHEDULED APPOINTMENT WILL RESULT IN

1st Time - Warning given

2nd Time - Being charged 50% of the consult fee

3rd Time- Being charged 100% of the consult fee

All fees will need to be paid before any future bookings can be made.

 

  1. Late and Missed Appointments

5.1 Patients who either arrive late or miss an entire appointment will be charged the cancellation fee.

5.2 Patients arriving late to an appointment but within their time allocation, may receive a shorter consultation in an effort not to inconvenience other patients with scheduled appointments.

 

  1. Consent to Treatment

Physioactive requires the consent of clients both for processing client data and treatment. The client’s electronic signature/tick on the Initial Assessment form and Consent Forms electronically confirms that the client has read and understood the terms and conditions and that you acknowledge and accept the following:

6.1 Consent to our physiotherapists to perform all necessary examinations, manipulations, therapy, rehabilitation and medical diagnostic procedures in accordance with their professional training and understanding of your injury.

6.2 Consent for treatment by the physiotherapist.

6.3 You have the right to see the physiotherapist of your choice, refuse intervention or seek a further opinion and to provide feedback and make a complaint.

6.4 At times there can be a low associated adverse risk with treatment which may include and not limited to- stiffness and soreness, soft tissue injury, neurological complications, cerebrovascular injuries, skin irritations, burns and other minor complications.

 

  1. Intellectual Property

7.1 All content on this Website, including text, images, and logos, is the property of Physioactive and is protected by copyright under laws of Australia and through international treaties.

7.2 Physioactive does not grant you any other rights whatsoever in relation to the Website or the content. All other rights are expressly reserved by Physioactive.

7.3 You may not, without the prior written permission of Physioactive republish, upload to a third party, transmit, post, distribute, show or play in public, adapt or change in any way the content or third party content for any purpose, unless otherwise provided by these Terms.

 

  1. Disclaimer of Liability

8.1 The information on this Website is for general informational purposes only and is not a substitute for professional medical advice.

8.2 Physioactive is not responsible for any consequences arising from the use of the information on this Website.

8.3 Consult with a registered physiotherapist or healthcare professional for specific medical advice.

8.4 We cannot be liable for any incorrect information supplied by you to us. If you experience any pain or discomfort, please alert us immediately and cease using the treatment program

8.5 All Physiotherapists employed at Physioactive are registered Physiotherapists with the Australian Health Practitioners Regulation Authority (AHPRA). In addition, they are members of the Australian Physiotherapy Association (APA).

 

  1. Limitation of Liability

9.1 In no event shall Physioactive employees or their directors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly out of any of the treatments or procedures delivered in this clinic which does not arise from any negligent act or omission of the employees or directors.

9.2 Whilst every care has been taken to ensure the information on this website is both accurate and up to date, we do not accept any liability to any party for loss, or damage incurred by reliance placed on the information contained in this website or through omission or errors how so ever caused.

10.1 You agree to indemnify and hold Physioactive harmless from any claims, actions, or demands arising out of your use of the Website or any violation of these Terms.

11.1 Physioactive may terminate or suspend your access to the Website at any time for any reason, without notice.

11.2 If you want to terminate the Terms, you may do so by providing Physioactive with 7 days' notice of your intention to terminate by sending notice of your intention to terminate to Physioactive via the 'Contact Us' link on our homepage.

15.2 Name, Contact information (email address, phone number, address), Date of birth, Medical history and health-related information, Insurance information, Medicare Number, Payment details for billing purposes.

15.3 Physioactive uses SMS and/or email communication to keep you up to date with the status of your appointment.

15.4 Medical information including medical history, medications, allergies, adverse events as well as relevant social and family histories

15.5 We may also collect non-personal information such as:

Browser type, Operating system, IP address, Date and time of access, Pages visited

15.6 We may use cookies and similar tracking technologies to enhance your experience on our website. You can disable cookies through your browser settings, but this may affect your experience on our website.

15.7 Our website may from time to time use cookies to analyses website traffic and help us provide a better website visitor experience. In addition, cookies may be used to serve relevant ads to website visitors through third party services such as Google. These ads may appear on this website or other websites you.

This information is used in an aggregated manner to analyse how people use our site, such that we can improve our service.

  1. Refund Policy

17.1 Physioactive is not required to provide a full refund or replacement if you change your mind on stock related items. But you can choose a refund, exchange or credit if an item has a major fault which has been approved by the manufacturer and is under warranty.

17.2 Physioactive will accept an exchange ONLY for items that are in new condition, unworn/unused, unaltered and free of damages by the customer. Items must be returned with all tags still attached and must be in the original packaging. You must have the receipt or proof of purchase and this must be done within 7 days of purchasing.

17.3 Due to hygiene reasons some items are not available for exchange.
